The present general conditions of sale apply to any order placed from the website www.wemoove-tv.tech [hereafter "the Site"].
The Site is operated on behalf of WEMOOVE, a single-member simplified joint stock company with SIRET number 804 967776, whose registered office is located at 18 rue de la Promenade, 92600 ASNIERES-SUR SEINE (hereinafter referred to as "WEMOOVE").
The possibility of ordering products available on the Site (hereinafter the "Products") is reserved for private individuals, i.e. consumers who are acting for purposes that are not part of their professional activity [hereinafter the "Customer(s)"]. Professional customers wishing to order Products can contact us at +33 (0)1 73 63 81 34 or by email at contact@wemoove.tech.
WEMOOVE reserves the right to adapt or modify these terms and conditions of sale at any time. The general terms and conditions of sale applicable to an order are those published on the Site on the date the order is placed.
Access to the Site
The Customer is personally responsible for setting up the computer and telecommunication means allowing him/her to access the Site. The Customer shall bear the cost of telecommunications when accessing the Internet and using the Site.
Orders are placed exclusively on the Site.
To place an order from the Site, the Customer must create an account. The creation of the account is done during the first order as detailed in the article. When the creation of the account is validated, the Customer will receive by email a confirmation of his registration and his personal identifiers. The Customer will then be able to access his account on the Site and place an order using his identifiers.
The Products
The Products offered on the Site comply with the French legislation in force and the standards applicable in France.
In accordance with the provisions of Article L.111-1 of the Consumer Code, the Customer may, beforehand, take note on the Site of the essential characteristics of the Product(s) he/she wishes to order.
Availability of Products
The offers presented on the Site are valid within the limits of available stocks. The Customer is informed about the availability of the Product by the mention "delivery expected between "date" and "date"" or "in the process of being restocked" located below the icon "Add to cart".
No information will be communicated concerning the availability of a Product that is no longer in stock.

Please note that our special offers are only valid in our online store, while stocks last and for a limited time.
The products ''offered'' or benefiting from a discount must be added in the same basket as the product giving access to the offer.
The products offered or benefiting from a special discount are indicated in the offer. Please make sure you select the right product reference when ordering.
Prices and shipping costs
6.1 The prices displayed on the Site are expressed in euros and include all taxes.
6.2 The price that applies is the one displayed at the time of the order. The sale prices of Products may be modified by WEMOOVE at any time but WEMOOVE undertakes to apply the prices in force at the time the order is registered subject to the availability of the Products on that date.
6.3 The Eco-Participation is included in the selling price of the Product ordered.
6.4 Notwithstanding the foregoing, if WEMOOVE discovers an error in the price of the Products ordered, WEMOOVE reserves the right to cancel the order and invite the Customer to place a new order for the Products at the correct price. If WEMOOVE is unable to contact the Customer, it will treat the order as cancelled. In these circumstances, if payment has already been made, the Customer will receive a refund of its cancelled order from WEMOOVE.
Controls
When placing the order, the Customer guarantees to have the full legal capacity to adhere to the conditions of sale.
The Customer accesses the Products offer from the home page by clicking on one of the tabs proposed.
- BASKET
The Customer selects the Products he/she wishes to order by clicking on the "Add to cart" icon. The Customer is then automatically directed to the page summarizing the contents of the basket. The Customer can then either continue shopping by clicking on the "Continue Shopping" icon or order by clicking on the "Checkout" icon and be directed to the next step.
The Customer can also display the contents of his basket at any time by clicking on the icon in the upper right-hand corner representing a shopping cart.
- CONNECT
The Customer must enter his identifiers communicated during the creation of his account.
If this is the Customer's first order, he/she must click on the "create an account" icon. After having filled in the requested information, the Customer clicks on "No account? Create one".
A confirmation email will then be sent to the Customer
- BILLING
The Customer fills in the requested information regarding the billing address and the payment method. The billing address must be the same as the one attached to the payment card used to place the order.
In addition, the Customer enters the promotional code if he/she has such a code.
Then the Customer clicks on the "continue" icon.
- EXPEDITION
The delivery address is automatically filled in by the site. The customer has the option to have the order delivered to an address different from the billing address by modifying the data appearing on the screen.
- LAST CHECK
The following page summarizes the Products in the Customer's shopping cart, their price including all taxes, the total amount of the order.
The Customer then checks the conditions of his order. If an error in the data entry has been made, the Customer may either renounce his order by returning to the previous pages or by closing the current session of the Site, or modify the content of his order by proceeding to a new data entry.
The Customer, having checked the box indicating that he/she accepts without reservation the terms of the present sales conditions, can then confirm his/her order by clicking on the "Place Order" icon.
- PAYMENT
The customer fills in his bank details required for payment and confirms his order by clicking on the "send" icon.
From the moment the Customer has registered his/her order by clicking on the "confirm" icon, he/she is deemed to have accepted without reservation the present terms of sale, the prices and quantities of the Products ordered, the shipping costs and the amount of the eco-contribution.
- The next page provides a confirmation of the order by indicating an order number. An email, confirming the order and containing the same information will also be sent to the Customer. WEMOOVE recommends that the Customer keep this information on a paper or computer document.
The sale will only be considered final after WEMOOVE has sent the Customer confirmation of the order and the payment of the full price has been received.
- The data recorded by WEMOOVE constitutes proof of the nature, content and date of the order. This data is archived by WEMOOVE. The Customer can consult this data on the Site by clicking on the "My Account" icon on the home page and then on the "Orders" icon.
WEMOOVE reserves the right to refuse an order in the event that the Product is unavailable, the amount of the order cannot be debited from the Bank Account, or in the event that the price displayed on the Site on the date of the order is marred by a material error.
If an order is refused or if it cannot be processed for any reason whatsoever, WEMOOVE undertakes to reimburse as soon as possible (and at the latest within 30 days of the notification to WEMOOVE of the event that gave rise to the order) the Customer whose Bank Account has been debited pursuant to Article 8 of these general terms and conditions of sale.
Payment
8.1 Payment is made at the time of ordering, by credit card. The credit cards that are accepted are indicated on the Site when the order is placed.
8.2 By providing its bank details, the Customer agrees in advance and unconditionally that WEMOOVE may proceed with the secure transaction. The Customer therefore authorizes its bank to debit its sight account with the records or statements transmitted by WEMOOVE or any company appointed by WEMOOVE, even in the absence of invoices signed by the account holder.
8.3 The invoice for the order will be sent in a subsequent email, confirming WEMOOVE's final acceptance of the order. Invoices will be sent to the Customer in electronic format (PDF) and must be kept by the Customer.
Payment in [3X, 4X or deferred without fees] by credit card with our partner FLOA.
Our financial partner, FLOA, offers deferred payment solutions for your purchases of goods and/or services, in 3 or 4 installments by credit card. These payment solutions are reserved for individuals (natural persons of legal age) residing in France, holding a Visa or MasterCard bank card with a validity date corresponding to the duration of the refund. Delivery
Deliveries are made throughout Europe. Depending on the country of delivery, additional shipping costs may apply.
The delivery costs are free except in the case mentioned above.
Delivery is made to the address indicated by the Customer and according to the method chosen by WEMOOVE depending on the gross weight of the order. In the event of an error by the Customer in entering the delivery details, WEMOOVE shall not be held responsible for failure to deliver and for any consequences thereof.
The orders whose gross weight is lower than 15 kg are delivered by DPD. A follow-up at the delivery address will be indicated by the Customer during his order.
Orders with a gross weight of 15 kg or more are delivered by one of the following WEMOOVE service providers: DPD, UPS, Schenker, Legendre (hereinafter the Carrier). In case of absence of the recipient, a notice of passage is left by the Carrier. This document allows the recipient to contact the Carrier by telephone to set up a delivery appointment (the place of delivery cannot be different from the one specified at the time of the order) or to come and pick up the order at the Carrier's office. In the event that the delivery is not made during the 15-day period following the delivery notice, the package will be returned to WEMOOVE which will automatically refund the order. If the Customer wishes to maintain its order, it must re-enter its order on the Site. ALL DELIVERIES ARE MADE TO THE "BOTTOM OF THE BUILDING". IN ALL CASES, NO INSTALLATION OF PRODUCTS WILL BE CARRIED OUT.
The delivery time is 8 working days maximum from the order when the product is available.
Claims for non-delivery will not be processed until 8 days after the order has been placed.
The products are sometimes stored in different warehouses, so it is possible to receive your order in several packages.
THE CUSTOMER IS REQUIRED TO VERIFY THE PHYSICAL CONDITION AND CONTENTS OF THE PACKAGE(S) UPON DELIVERY, IN THE PRESENCE OF THE CARRIER, BEFORE SIGNING THE DELIVERY RECEIPT. THE CUSTOMER IS REQUIRED TO RETURN TO THE CARRIER THE PRODUCTS THAT ARE NOT IN CONFORMITY WITH THE ORDER OR IN POOR PHYSICAL CONDITION AND TO MAKE THE NECESSARY RESERVATIONS ON THE TRANSPORT RECEIPT.
IN THE CASE THAT THE CARRIER OPPOSES THIS CONTROL, THE CUSTOMER MUST REFUSE THE PACKAGE OR PACKAGES AND MAKE A CLAIM FOR THE REASON "PACKAGE REFUSED" BY CALLING THE CUSTOMER SERVICE AT THE FOLLOWING NUMBER: +33 (0)1 73 63 81 34 (not surtaxed, variable cost according to operator), at the following times:
- Monday to Friday from 09:30 to 12:00 and from 14:00 to 18:00
The mention on the transport receipt "Subject to unpacking" shall not be considered as allowing the Customer to later contest the conformity of the delivered Product(s).
In the event that the Customer has any doubt whatsoever about the condition of the packaging or the Products contained in the packaging (visible damage, scratches, shocks, etc.), he/she must refuse them. Whether or not he refuses the delivery, the Customer must indicate on the Transport Receipt all his reservations, specifying the nature of the damage (damage, missing items) and the reference of the damaged or missing Product. Reservations that do not provide the details requested above will not be taken into account. AFTER SIGNING THE DELIVERY RECEIPT, THE CUSTOMER WILL NOT BE ABLE TO REPORT ANY FURTHER DAMAGE OR SHORTAGES.
Where applicable, the Customer shall inform WEMOOVE of its refusal to accept the delivery by following the procedure set out in the article COMPLAINTS.
Withdrawal
10.1 The Customer has a right of withdrawal during a period of 14 clear days as from the reception of the Products. When this period expires on a Saturday, Sunday or holiday, it is extended to the next working day. The Customer does not have to justify his withdrawal.
To exercise the right of withdrawal, the Customer must notify his decision to withdraw by means of an unambiguous statement. The Customer may use the standard withdrawal form, attached to these general terms and conditions, by printing it and sending it to the address indicated on the form.
10.2 The Products must be complete and in their original packaging in order to be returned. In addition, blister packs containing software and recording media must not be unsealed. Products returned to WEMOOVE that do not comply with these conditions will be refused and will remain at the disposal of the Customer at the carrier.
10.3 Before returning Products to WEMOOVE, the Customer must obtain a "Return Form" by contacting CUSTOMER service. The "Return Form" will be sent to the Customer's e-mail address in the form of a PDF to be printed. In this return form, the procedure to follow to return the Product will be indicated (carrier to contact...). The respect of the procedure by the Customer is imperative.
10.4 Products must be returned within 8 days from the date of receipt of the "Return Form". Any return made after this period will not be taken into account. The "Return Form" must be attached to the returned Products. The Products are returned at the Customer's risk to the address indicated on the "Return Form". No returns can be received at WEMOOVE's headquarters; Products that have been sent by the Customer to WEMOOVE's headquarters will be refused and will remain at the disposal of the Customer at the Carrier.
10.5 In the event of the return of a Product in accordance with the above conditions, the Customer will be reimbursed for the price of the Product if, after verification, the Product is found to be in perfect working order and without defects. In the event that the Product has been damaged or does not work, the cost of repairing the Product will be deducted from the refund. The cost of returning the order will only be refunded if the entire order is returned and only if it was placed on the Site www.wemoove-tv.tech. WEMOOVE undertakes to reimburse the Customer within fourteen days of receipt of the withdrawal request, subject to receipt of the Product by WEMOOVE within the aforementioned period and subject to the Product being in perfect working order and without apparent defects.

In case of return of a Product in accordance with the conditions described above, the Customer will be reimbursed for the totality of the sums paid as soon as possible and at the latest within thirty days following the date on which this right was exercised, provided that the reasons invoked for this return are in conformity with the present conditions of sale and that the stipulations in article 9 are respected.
Warranty
12.1 In addition to the legal warranties provided for in articles 1641 et seq. of the Civil Code* as well as article 2232 of the Civil Code and articles L.211-1 et seq. of the Consumer Code**, WEMOOVE offers, for the finished Products presented on the Site, a two-year warranty, parts and labor, from the date of purchase of the Product by the Customer. For Accessories essential to the proper functioning of a product (Products present in the e-Access tab of the Site), the warranty is two years parts and labor from the date of purchase by the Customer except in cases stipulated on the Site. In case of doubt, do not hesitate to refer to the Warranty Certificate for TVs (TV Warranty), which accompanies the products.
The effective date of the guarantee is the date shown on the invoice.
Article L.211-16 of the French Consumer Code: "When the buyer asks the seller, during the course of the commercial warranty granted to him at the time of the acquisition or repair of a movable good, for a repair covered by the warranty, any period of immobilization of at least seven days is added to the duration of the warranty that remained to run. This period shall run from the date of the buyer's request for intervention or from the time the item in question is made available for repair, if this is after the request for intervention.
Spare parts are available for a minimum of five years from the date of first sale of the Product concerned.
12.2 The warranty does not apply to damage caused in the following cases:
Warranty Limits:
- The warranty applies only to the first owner and is not transferable upon resale
- The warranty applies only to use under normal conditions of use (excluding rental or other professional use) and does not cover damage resulting from misuse, failure to observe safety precautions or accident.
- The warranty does not cover damage caused by repairs performed by an unauthorized technician or resulting from improper maintenance.
- Modification of any component of the product (frame and/or part, including paint, charger) can result in serious injury, fire and voids the warranty.
- The warranty does not cover damage to parts with visible impact marks.
Case of cancellation of the guarantee :
- The instructions for use, maintenance, adjustments and all other instructions in the user's manual have not been followed;
- The product has been modified or altered by the user or by unauthorized technicians without the prior written consent of WEMOOVE;
- Components of the product have been replaced with parts of another brand;
- Any repairs were performed by an unauthorized technician.
Warranty is denied:
- If the problem is due to a cause unrelated to the quality of the product (accident, shock, fall, bad weather, ...) ;
- For wear parts listed above and replacement labor ;
- For everything that falls within the scope of the interview;
- For abnormal use outside the normal conditions of use, even for a short time;
- For wrong settings;
- For professional, rental or community use;
- In case of impact of external elements or agents (natural disaster, fire, humidity) ;
- If the product is used in a manner that does not comply with technical and safety standards;
- If another use than the one foreseen by the standard of the product concerned has been realized ;
- In case of paint wear and product degradation due to impacts, falls and/or accidents.
In all these cases, the repair is the responsibility of the Customer.
To find this exhaustive list of warranty exemptions, simply refer to the Warranty Certificate for TVs and monitors (TV Warranty) supplied with the products.
12.3 To be eligible for warranty, Accessories must be returned at the Customer's expense and risk to one of WEMOOVE's authorized technical stations, accompanied by a copy of the sales invoice. The list of these technical stations (repair centers) will be indicated by WEMOOVE after opening a technical assistance file at the following e-mail address: service@wemoove.tech. No Product may be returned to WEMOOVE headquarters without authorization. Products sent by the Customer to WEMOOVE's headquarters without authorization will be refused and will remain at the disposal of the Customer at the Carrier.
Screen repairs can be carried out at home, after opening an assistance file at the email address service@wemoove.tech and after diagnosis and acceptance by the WEMOOVE after-sales team. For the sake of convenience, the Customer may be asked to repack the screen in its original box so that WEMOOVE can send the product to a repair center (list of repair centers available upon request).
12.4 If WEMOOVE assumes the costs of repair, WEMOOVE shall pay the costs directly to the authorized technical station. The Products repaired by the authorized technical station are sent to the Customer at the Customer's risk. In the case of an intervention at home and in the event that the Product cannot be repaired, the Product will be taken to the technical station for further analysis and will be returned to the Customer once repaired.
*Article 1641 of the Civil Code: "The seller is bound by the warranty for hidden defects of the thing sold which make it unfit for the purpose for which it was intended, or which so diminish this use that the buyer would not have acquired it, or would have given a lesser price, had he known of them;
Paragraph 1 of Article 1648 of the Civil Code: "The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect.
**Article L. 211-4 of the French Consumer Code: "The seller is required to deliver goods in conformity with the contract and is responsible for any defects in conformity existing at the time of delivery. He is also responsible for defects in conformity resulting from the packaging, the assembly instructions or the installation when the latter has been put at his charge by the contract or has been carried out under his responsibility";
Article L. 211-5 of the Consumer Code: "To be in conformity with the contract, the goods must :
- Be fit for the purpose usually expected of similar goods and, if applicable; - correspond to the description given by the seller and possess the qualities that the seller has presented to the buyer in the form of a sample or model; - have the qualities that a buyer may legitimately expect in view of the public statements made by the seller, by the producer or by his representative, in particular in advertising or labelling;
- Or have the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and that the latter has accepted;
Article L. 211-12 of the Consumer Code: "The action resulting from the defect of conformity is prescribed by two years as from the delivery of the good";
Environment
13.1 Pursuant to Articles R543-172 to R543-206 of the Environmental Code on electrical and electronic equipment ("EEE"), WEMOOVE hereby informs the Customer of the potential effects on the environment and human health of the presence of hazardous substances in the EEE.
13.2 The Customer shall not dispose of the product in the household waste garbage cans with other unsorted municipal waste, but shall use the selective collection points provided for the treatment of waste from E.E.
13.3 In accordance with articles R543-172 to R543-206 of the Environment Code on electrical and electronic equipment ("EEE")
- or go to the website http://www.icijerecycle.org/ published by Eco-Systèmes, an eco-organization approved by the public authorities for the collection and processing of household waste electrical and electronic equipment (WEEE), and drop off the used equipment at the local collection points indicated on the said site,
- or, for equipment >15 kgs, ask WEMOOVE to take back the used E.E. free of charge when purchasing a Product:
- Standard delivery + material recovery with the following restriction: for a delivered device, only one used device can be taken back, these devices must be of equivalent type or ensuring the same function. The devices taken back must be available for collection at the time of delivery, i.e. taken down to the foot of the building.
Responsibility
In no case shall WEMOOVE be held responsible for any non-performance attributable either to the Customer or to a third party, or in case of force majeure.

- Information Technology and Civil Liberties
17.1 In accordance with the law n° 78-17 of January 6, 1978 modified in 2004, the processing of personal information provided to WEMOOVE by the Customer when using the Site has been declared to the Commission Nationale de l'Informatique et des Libertés.
17.2 The Customer has the right to access and rectify information concerning him/her, which he/she may exercise by sending a written request to the following postal address

Similarly, the Customer may also, for legitimate reasons, object to the processing of data concerning him.
Proof
By express agreement, electronic communications are considered by WEMOOVE as well as by the Customer to have a probative value equivalent to that of written documents.
Applicable law and competent courts
THE PRESENT GENERAL CONDITIONS OF SALE ARE GOVERNED BY FRENCH LAW. ANY DISPUTE ARISING FROM THEIR APPLICATION SHALL BE UNDER THE EXCLUSIVE JURISDICTION OF THE FRENCH COURTS.
