- " Terms and Conditions of Use "means the present general terms and conditions of use of the
Site by a User;
" Website Website": means the WEMOOVE website, accessible from the domain name www.wemoove-tv.tech. The Website includes all computer components (in particular software and computer developments and web pages, including source and object code programs, domain names, preparatory design work, specifications and preliminary studies, user documentation, database), the graphic design (including projects, models, prototypes and plans), the content (in particular textual, graphic, sound, photographic and multimedia elements), as well as all related rights;
- " User The term " : refers to the natural or legal person who navigates on the Site;
- " WEMOOVE WEMOOVE": refers to the company WEMOOVE, in the form of a Société par Action Simplifiée à associé Unique (simplified joint stock company with a single shareholder) with a capital of 1,000.00 euros, whose registered office is located at 18 rue de la Promenade in Asnières-sur-Seine (92600), registered with the Nanterre Trade and Companies Registry under the Siret number 804 967 776. WEMOOVE owns the WEMOOVE brand and markets consumer electronics and household appliance products under this brand.
Access to the Site and its use by the User are subject to these General Conditions
of Use.
USE OF THE SITE OR ANY OF ITS FEATURES IMPLIES EXPRESS, PRIOR, FULL AND COMPLETE ACCEPTANCE OF THESE TERMS OF USE. ACCESSING AND BROWSING THE SITE CONSTITUTES FULL ACCEPTANCE OF THESE TERMS OF USE.
The purpose of the General Terms of Use is to define the terms and conditions under which Users access, browse and use the Site.
The Site is a platform whose purpose is to inform users about the products marketed
under the WEMOOVE brand distributed and available in France and Europe. The Site allows in particular
to consumers:
- to consult the specificities of the products sold under the WEMOOVE brand;
- to access the after-sales service conditions for WEMOOVE products;
- to consult the list of retailers offering WEMOOVE products for sale;
- to download the documentation of the products sold under the WEMOOVE brand;
- to consult photos of installations made with WEMOOVE products;
- access extracts of press articles / videos about the WEMOOVE brand.
The User accesses the Site via the url www.wemoove-tv.tech.
4.1- WEMOOVE makes every effort to ensure the availability of the Website. WEMOOVE does not guarantee that the Website will function in any operating environment and that it will be usable at all times without interruption or error, nor that all errors can be corrected.
4.2- The User is informed that the availability of the Site is subject to a simple obligation of means. WEMOOVE shall not be liable in any way for the unavailability of the Website.
4.3- The Site is constantly evolving and is therefore subject to occasional changes and/or temporary or permanent interruptions without prior notice, in particular for maintenance reasons. WEMOOVE shall not be liable in any way for the unavailability of the Site due to such changes.
WEMOOVE cannot be held responsible for any damage suffered by a User in the context of abnormal use of the services offered on the Site, and in particular in the event of violation of these Terms of Use. WEMOOVE shall not be liable for any direct or indirect damages, losses or expenses resulting from the use of the Website, or the inability to use it, or from a malfunction, an interruption due to maintenance, technical failure of the server hosting the Website or related to an interruption in Internet access or for any other cause, a virus, or a line or system problem. When using the Site, the User undertakes in particular to:
- not to modify or alter all or part of the Site;
- not to authorize any other person to use your email and password;
- not to use the email and password of another User;
- not to disseminate any message(s) or information(s) in any form or nature:
* contrary to public order and morality;
* contrary to the respect of privacy ;

The User guarantees and indemnifies WEMOOVE against any damage suffered by it and against any liability action that may be brought against it on the basis of the violation of these Terms of Use. In the event of fraud (falsification, concealment, etc.), the Site authorizes itself to communicate all necessary information to the competent bodies responsible for the repression of such frauds and offences.
6.1- The Website is protected by intellectual property rights held by WEMOOVE. Consequently, they may only be used by the User in accordance with the conditions set forth in these Terms of Use. Any other use, in particular constituting counterfeiting, is liable to sanction. Any reproduction, even partial, of the content of the Website is strictly prohibited, except with prior authorization from WEMOOVE. More generally, any distribution, reproduction, representation or adaptation, in whole or in part, of the Site or of any of its elements is prohibited, as is any alteration thereof. "WEMOOVE" is a protected trademark registered in particular with the INPI, on August 13, 2015, under the registration number 4203248 (hereinafter referred to as the "Trademark"). The domain name wemoove-tv.tech (hereinafter referred to as the "Domain Name") has been reserved by WEMOOVE. The use of the Brand and the Domain Name is reserved to WEMOOVE. Therefore, the User is not allowed to use the Brand and/or the Domain Name in any way or form whatsoever without prior written consent of WEMOOVE. Furthermore, the User undertakes not to register or file all or part of the Brand and/or Domain Name or any similar sign in any way whatsoever with competent bodies.
6.2- These Terms of Use do not imply any transfer of intellectual property rights from WEMOOVE to the User. The User is granted a non-exclusive, revocable and non-transferable license to use the Website for the entire duration of its registration. The User undertakes : - not to grant any sub-license to use the Site; - not to assign this license.
7.1- The Site complies with French standards relating to the protection of privacy and personal data, and in particular with Law No. 78-17 of January 6, 1978 relating to information technology, files and freedoms, amended by Law 2004-801 of August 6, 2004.
7.2 - When using the Website, the User provides personal information about himself. The provision of this information is mandatory to use the services offered by WEMOOVE. In addition, connection data may be collected by WEMOOVE. The data collected by WEMOOVE is confidential and will only be used by its internal services in the context of the management of the Website for the purposes of statistics to estimate the number of visitors to the Website. The User has the possibility, at any time, to object without charge, except for those related to the transmission of the refusal, and in a simple manner, to the use of data concerning him/her. 7.3- In accordance with the French Data Protection Act of January 6, 1978, as amended by the Act of August 6, 2004, the User has the right to access, modify, rectify or delete any personal data concerning him/her at any time. To modify his personal information, the User can send an e-mail to contact@wemoove.tech. The User can also exercise a right of opposition.
WEMOOVE uses temporary internal cookies (non-stored session cookies), which are intended solely to assist navigation on the Site. The cookies used by WEMOOVE are in no way used to collect personal information about the User. If the User chooses to reject all cookies (including temporary internal cookies), access to the Site may be limited.
The use and operation of the Site are subject to French law. The validity, execution, and interpretation of these General Conditions of Use applicable to the Site are also subject to French law.
IF THE USER IS A PROFESSIONAL MERCHANT, THE EXCLUSIVE JURISDICTION TO HEAR ANY DISPUTE RELATING TO THE INTERPRETATION OR EXECUTION OF THE GENERAL CONDITIONS OF USE IS THE COMMERCIAL COURT OF NANTERRE.
